Terms of Service

Please read these terms before you use SurfCard.

These Terms of Service (the “Terms”) govern your use of the SurfCard website, apps and related services (together, the “Service”), which are owned and operated by Surfcard Technology Limited (“we”, “us”). By using or continuing to use the Service, you confirm that you have read and understood these Terms and agree to be bound by them.

1. Introduction

What the Service is

SurfCard provides digital business card profiles, business card scanning and contact management, profile analytics, tools for teams, and NFC business cards that open a profile when tapped.

Who these Terms apply to

These Terms apply to everyone who uses the Service, including visitors to the website and individual or company users of SurfCard products and services.

Changes to these Terms

We may revise these Terms at any time and will publish the revised version on this website. A revision takes effect on publication, so please review the latest version periodically.

2. Accounts and security

Creating an account

Parts of the Service require an account. When you register you must provide accurate, complete and current information, including your name and a valid email address.

Keeping your account secure

You are responsible for keeping your account and password safe, and for everything done through your account. Please tell us immediately if you believe your account has been used without your authorisation.

Suspension and termination

If we reasonably believe you have breached these Terms or acted improperly, we may suspend or terminate your account without prior notice.

3. Using the Service

Lawful use

You agree to use the Service only for lawful purposes and in accordance with these Terms, and not to engage in any unlawful or fraudulent activity or any activity that infringes the rights of others.

Prohibited content

You must not send, upload or share through the Service:

  • Content that breaks Hong Kong law, or infringes another person’s intellectual property, privacy or reputation
  • Viruses, malicious programs or any code that could damage a system
  • Personal data or sensitive information about another person that you have no right to share

Interference

You must not interfere with the normal operation of the Service, or attempt to access it without authorisation.

Content review

We may remove any content that breaches these Terms or is otherwise inappropriate, at our discretion and without prior notice.

4. Your content

Your rights, and the licence you give us

You confirm that you hold the legal rights to everything you upload or provide, and you grant us the non-exclusive, royalty-free, worldwide licence needed to operate the Service — for example, to publish your profile at the address you have chosen.

A published profile is public

A profile you publish can be opened by anyone holding its link, its QR code or a card that points at it. Publish only what you are willing to share with the people you hand it to.

Scanned business cards

When you use card scanning, the images you upload are processed automatically to extract their text, and the result is shown to you for review before anything is saved. You are responsible for having a lawful basis to record and use the details of the people whose cards you scan.

5. Buying a SurfCard

Orders and prices

Prices are in Hong Kong dollars and cover the card and the encoding of its chip. Delivery is charged separately and shown to you before you pay, and any import tax or duty a destination raises is not included. Your order is an offer to buy; the contract between us forms when we confirm the order by email. We may decline or cancel an order — for a pricing error, for artwork we cannot lawfully or physically print, or for a delivery address we cannot serve — and where we do, we refund it in full.

Payment

Payment is handled by our payment provider on its own secure page, and we never see or store your full card number. Nothing is produced until the provider confirms that the payment succeeded.

Artwork you supply

If you order a card printed from your own artwork, you confirm that you hold the rights to everything in it. We check every design before it prints and may ask you for changes, or decline to print it. Once you approve the print file we print it exactly as approved, including any mistake it contains.

Delivery and risk

We deliver to the address you give at checkout, by the carrier and the options set out in our Shipping Policy. Risk in the cards passes to you when the carrier hands the parcel to you or to the collection point you chose.

Cancellation, faults and warranty

Cards are made to your order and their chips are encoded for it, so an order cannot be cancelled or changed once it is paid, and we do not accept returns because you have changed your mind. A card that arrives damaged, does not work, or is not what you ordered is put right under our Returns and Refunds Policy, and every card carries the twelve months of cover set out in our Card Warranty. Both documents form part of these Terms.

Subscriptions

A paid plan is billed in advance and renews until you cancel it. Cancelling stops the next renewal and keeps the plan running to the end of the period you have paid for; a period that has started is not refunded. A plan bought inside our iPhone or Android app is billed by Apple or Google under their own terms, and is cancelled — and refunded, if they agree to it — through that store.

6. Intellectual property

The SurfCard platform, trade marks, logos, designs, software and all related intellectual property belong to Surfcard Technology Limited or its licensors, and may not be used, copied, modified or distributed without our written consent. This does not affect the rights you hold in the content you upload.

7. Privacy and data protection

We handle your personal data in accordance with the Personal Data (Privacy) Ordinance (Cap. 486 of the Laws of Hong Kong) and with our Privacy Policy. Please read the Privacy Policy to understand how your data is collected, used, stored and protected.

8. Cookies

Our website uses cookies to improve browsing, to analyse traffic and to provide a personalised service. You can manage or disable cookies in your browser settings, though some features may then not work. Our Cookies Policy sets this out in detail.

9. Changes to the Service

We may modify, suspend or discontinue the Service or any part of it at any time, without prior notice.

10. Disclaimer and limitation of liability

Provided as is

The Service is provided on an “as is” and “as available” basis. We give no express or implied warranty as to its fitness for a particular purpose, its reliability, or that it will be free of errors.

Interruptions

We work to keep information accurate and the system stable, but we do not guarantee that the Service will never be interrupted. We are not liable for suspension of service or loss of data caused by network interruption, system maintenance, or events beyond our reasonable control, including natural disasters, government action and attacks on our systems.

Limitation

To the fullest extent permitted by law, we are not liable for any direct, indirect, incidental or consequential loss arising from your use of, or inability to use, the Service, including loss of profit, business interruption or loss of data.

Content published by users

The details published on a profile are provided by the user. Any dispute or liability arising from content a user provides is that user’s own responsibility.

11. Third-party links

The Service may contain links to third-party websites or services, provided for your convenience. We are not responsible for their content, their privacy practices or the way they operate.

12. Governing law and disputes

These Terms are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. Any dispute arising out of or in connection with them is subject to the exclusive jurisdiction of the Hong Kong courts.
